Pacific Iron Rental LLC (“Company,” “we,” “our,” “us”) respects your privacy and is committed to protecting the personal information you provide to us. This Privacy Policy (“Policy”) describes how we collect, use, disclose, store, and protect your personal information when you visit our website at pacificironrental.com (the “Site”), book or use our equipment rental services, or otherwise interact with us.
By accessing the Site, submitting a booking, or using our services, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree with this Policy, please do not use our Site or services.
This Policy is incorporated by reference into our Terms & Conditions and Rental Agreement. Capitalized terms not defined herein have the meanings assigned to them in our Terms & Conditions.
2. Information We Collect
We collect the following categories of personal information:
2.1 Information You Provide Directly
When you book equipment, create an account, contact us, or otherwise interact with us, you may provide:
- Identity Information: Full legal name, date of birth, government-issued photo ID (e.g., driver’s license number)
- Contact Information: Email address, phone number, mailing address, and Job Site address
- Payment Information: Credit card number, expiration date, billing address, and cardholder name (processed and stored by our third-party payment processor, Stripe — we do not store full credit card numbers on our servers)
- Rental Information: Booking dates, rental duration, equipment selected, delivery preferences, Job Site details, and special instructions
- Business Information: Company name, title, contractor license number, and employer identification number (if renting on behalf of a business)
- Communications: Content of emails, text messages, phone calls, and any other correspondence with us
- Insurance Information: Insurance provider name, policy number, and certificate of insurance (if provided)
- Electronic Signatures: Signatures captured through DocuSign or other electronic signature platforms in connection with the Rental Agreement and Waiver of Liability
2.2 Information Collected Automatically
When you visit our Site, we automatically collect certain information through cookies, analytics tools, and similar technologies:
- Device Information: IP address, browser type and version, operating system, device type, screen resolution, and unique device identifiers
- Usage Information: Pages visited, links clicked, time spent on pages, referring URL, and browsing patterns on the Site
- Location Information: Approximate geographic location derived from your IP address (we do not collect precise GPS location from your personal device)
- Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to operate the Site, remember your preferences, analyze traffic, and improve your experience. See Section 8 (Cookies & Tracking Technologies) for details.
2.3 GPS & Equipment Tracking Data
All Pacific Iron Rental equipment is equipped with GPS tracking devices. During the Rental Period, these devices collect:
- Equipment Location Data: Real-time and historical geographic coordinates of the Equipment
- Operational Data: Engine hours, idle time, movement alerts, startup/shutdown events, and geofence breach alerts
GPS tracking data is collected for the following purposes: equipment security and theft prevention, loss recovery, verification of compliance with the Rental Agreement (including geofence and prohibited use restrictions), logistics and delivery coordination, maintenance scheduling, and accurate invoicing.
By booking and accepting delivery of the Equipment, you expressly acknowledge and consent to the collection and use of GPS tracking data as described in this Policy and in Section 19 (GPS Tracking & Right to Inspect) of our Terms & Conditions.
2.4 Information from Third Parties
We may receive information about you from third-party sources, including:
- Payment Processor (Stripe): Transaction confirmations, payment status, fraud risk assessments, and payment method details
- Electronic Signature Provider (DocuSign): Signed documents, signature timestamps, IP addresses at the time of signing, and authentication records
- Communication Services: Email delivery and open status (via Resend), SMS delivery status (via Twilio)
- Public Records: Business registration information, contractor license verification, and similar publicly available data
3. How We Use Your Information
We use your personal information for the following purposes:
Service Delivery & Rental Operations
- Processing and confirming bookings and payments
- Delivering, tracking, maintaining, and retrieving Equipment
- Conducting pre-rental and post-rental inspections
- Communicating with you about your reservation, delivery schedule, rental status, and return
- Processing security deposit holds, charges, and refunds
- Enforcing the Terms & Conditions and Rental Agreement
Security & Loss Prevention
- Monitoring Equipment location and status via GPS tracking
- Detecting, preventing, and responding to theft, fraud, unauthorized use, or breach of the Rental Agreement
- Recovering lost or stolen Equipment
- Verifying the identity of Renters and authorized operators
Legal & Compliance
- Complying with applicable federal, state, and local laws, regulations, and legal obligations
- Responding to subpoenas, court orders, law enforcement requests, and other legal processes
- Establishing, exercising, or defending legal claims
- Maintaining records required by tax, financial, or regulatory authorities
Business Operations & Improvement
- Analyzing usage patterns to improve our Site, services, and customer experience
- Maintaining internal business records and accounting
- Training and quality assurance
- Communicating service updates, safety notices, or changes to our policies
4. How We Share Your Information
We do not sell, trade, or rent your personal information to third parties for their marketing purposes. We may share your information in the following limited circumstances:
- Service Providers: We share information with trusted third-party service providers who perform services on our behalf, including payment processing (Stripe), electronic signatures (DocuSign), email communications (Resend), SMS notifications (Twilio), website hosting (Vercel), and analytics. These providers are contractually obligated to use your information only for the purposes of providing services to us and are required to maintain its confidentiality.
- GPS Tracking Providers: Equipment location and operational data is transmitted to and processed by our GPS tracking service provider solely for security, logistics, and equipment management purposes.
- Insurance: We may share rental records, Equipment condition reports, and incident information with our insurance carrier in connection with claims, audits, or coverage verification.
- Legal Requirements: We may disclose your information if required by law, regulation, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Pacific Iron Rental LLC, our customers, or the public.
- Law Enforcement: We may share information, including GPS tracking data and Renter identification, with law enforcement agencies in connection with theft reports, property crimes, fraud investigations, or other criminal matters involving our Equipment.
- Business Transfers: In the event of a merger, acquisition, sale of assets, reorganization, bankruptcy, or similar transaction, your information may be transferred as part of the transaction. We will provide notice before your information becomes subject to a different privacy policy.
- With Your Consent: We may share your information for other purposes with your express consent.
5. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods include:
- Rental Records: Retained for a minimum of 7 years following the end of the rental for tax, accounting, and legal compliance purposes
- Payment Records: Retained for a minimum of 7 years as required by tax and financial regulations. Credit card data is stored and managed by Stripe in accordance with PCI-DSS standards; we do not retain full card numbers
- GPS Tracking Data: Retained for up to 2 years following the end of the rental for security, dispute resolution, and operational analysis purposes, unless a longer retention is required for an active legal matter or insurance claim
- Communications: Email, SMS, and phone records retained for up to 3 years
- Website Analytics: Aggregated and anonymized analytics data may be retained indefinitely. Identifiable website usage data is retained for up to 2 years
- Signed Documents: Rental Agreements, Waivers of Liability, and related signed documents retained for a minimum of 7 years
When personal information is no longer needed, we will securely delete or anonymize it in accordance with our data management practices.
6. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, destruction, or loss. These measures include:
- Encryption of data in transit using TLS/SSL protocols
- Secure, PCI-DSS compliant payment processing through Stripe (we never see or store your full credit card number)
- Access controls limiting employee and contractor access to personal information on a need-to-know basis
- Secure storage of signed documents through DocuSign’s enterprise-grade security infrastructure
- Regular review of security practices and vendor security postures
No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

We use Stripe for payments, analytics, and other business services. Stripe may collect personal data including via cookies and similar technologies. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection, loss prevention, authentication, and analytics. 8. Cookies & Tracking Technologies
We use cookies and similar tracking technologies on our Site. Cookies are small text files stored on your device that help us operate the Site, analyze traffic, and improve your experience.
Types of cookies we use:
- Essential Cookies: Required for the Site to function properly, including session management, booking functionality, and security features. These cannot be disabled.
- Analytics Cookies: Help us understand how visitors interact with the Site by collecting anonymized usage data (e.g., Google Analytics). These help us improve site performance and content.

9. Your Privacy Rights

While Pacific Iron Rental LLC is not currently subject to the California Consumer Privacy Act (CCPA) based on our size and revenue, we respect your privacy and will accommodate reasonable requests to the extent practicable.
You may request the following:

- Correction: Correction of inaccurate or incomplete personal information
- Deletion: Deletion of your personal information, subject to our legal obligations to retain certain records (e.g., tax and financial records, signed legal agreements, records related to active or potential disputes)
- Opt-Out of Marketing Communications: You may opt out of promotional emails or text messages at any time by following the unsubscribe link in any marketing email or by replying STOP to any marketing text message. Opting out of marketing communications does not affect transactional or service-related communications (e.g., booking confirmations, delivery notifications, safety alerts)

We will not discriminate against you for exercising your privacy rights. Exercising your rights will not affect the terms of any rental or the services we provide to you.
10. Children's Privacy
Our Site and services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. Our equipment rental services are restricted to individuals who are at least 18 years of age, as set forth in our Terms & Conditions.
If we learn that we have collected personal information from a child under 18, we will take steps to promptly delete that information. If you believe we may have collected information from a child under 18, please contact us immediately at info@pacificironrental.com.
11. Do Not Track Signals
Some web browsers transmit “Do Not Track” (DNT) signals. Because there is no universally accepted standard for how to respond to DNT signals, our Site does not currently respond to DNT signals. However, as stated in Section 8, we do not engage in behavioral advertising or cross-site tracking.
12. Text Message (SMS) Communications
If you provide your phone number and consent to receive text messages, we may send you SMS notifications related to your rental, including booking confirmations, delivery updates, return reminders, and important service alerts. By providing your phone number and consenting to SMS communications, you agree to the following:
- Message frequency varies based on rental activity
- Message and data rates may apply depending on your carrier and plan
- You may opt out of SMS communications at any time by replying STOP to any message
- Opting out of SMS will not affect your ability to use our services; we will communicate via email or phone instead
- We will not share your phone number with third parties for their marketing purposes
- SMS opt-in data and consent will not be shared with any third parties for marketing or promotional purposes
13. Data Transfers
Your personal information is processed and stored in the United States. Our third-party service providers (Stripe, DocuSign, Twilio, Resend, Vercel) may process or store data in various locations, including outside of California. By using our services, you consent to the transfer and processing of your personal information in the United States and, where applicable, in other jurisdictions where our service providers operate, subject to their respective privacy policies and applicable data protection requirements.
14. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. Changes are effective upon posting to our Site. The “Last Updated” date at the top of this Policy reflects the most recent revision.
If we make material changes to how we collect, use, or share your personal information, we will provide notice through one or more of the following methods: a prominent notice on our Site, an email to the address associated with your account, or an SMS notification (if you have opted in to text communications).
Your continued use of our Site or services after any changes to this Policy constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.
15. Governing Law
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles, consistent with Section 25 (Governing Law & Dispute Resolution) of our Terms & Conditions.
16. Severability
If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
