This Equipment Rental Agreement (“Agreement”) is entered into between:

Equipment Description
The Company agrees to rent the following equipment to the Renter as a single package:
Kubota U27-4 Mini Excavator
- 2.7-metric-ton compact excavator
- 21.8 HP Kubota diesel engine
- Zero tail-swing design
- Maximum dig depth: 9 ft 4 in
- Maximum reach: 14 ft 7 in
- Standard digging bucket included
Big Tex 14LP-16 Low-Profile Dump Trailer
- 14,000 lb GVWR
- 16-ft bed with 24-inch sides
- 9,750 lb payload capacity
- Bumper-pull configuration
Rental Period
Late returns will be charged at the daily rate ($450/day) for each additional calendar day. Contact us at (949) 385-3576 to extend your rental before the scheduled pickup.
Pricing & Payment
A valid credit card is required at the time of booking via Stripe. Debit cards are not accepted. Your card is saved securely but is not charged at booking. At the time of delivery, an authorization hold will be placed on your credit card for the rental amount plus a $1,000 refundable security deposit. The rental amount is charged only after the equipment is returned, and the security deposit hold is released provided the equipment is returned in good condition.
Delivery & Pickup
The Company will deliver the equipment to the Renter's job site and pick it up at the end of the rental period. The Renter is responsible for:
- Providing a clear, accessible delivery path and level staging area suitable for the equipment
- Being present (or having an authorized representative present) at delivery and pickup to participate in the joint equipment inspection
- Ensuring the delivery location can support the weight of the equipment and delivery truck
- Notifying the Company of any access restrictions, HOA rules, street parking limitations, or permit requirements before delivery
- Obtaining all necessary permits, including 811 Underground Service Alert utility locates
Equipment Responsibility
During the rental period, the Renter agrees to:
- Operate the equipment only for its intended purpose and within rated capacity
- Not sublease, loan, or allow unauthorized persons to operate the equipment
- Keep the equipment secure and protected from theft, vandalism, and weather damage when not in use
- Return the equipment in the same condition as received, less normal wear and tear
- Refuel the excavator to the same level as delivered, or pre-pay the $75 fuel fee
- Immediately report any mechanical issues, damage, or safety concerns to the Company
- Not remove, alter, or tamper with GPS tracking devices, serial numbers, or safety labels
Damage, Loss & Liability
The Renter is financially responsible for:
- All damage to the equipment beyond normal wear and tear, assessed at repair or replacement cost
- Loss or theft of the equipment during the rental period
- Damage to third-party property, underground utilities, or structures caused during operation
- Any fines, penalties, or fees arising from the Renter’s use of the equipment
- Any environmental contamination or remediation costs arising from the Renter’s use of the equipment
The Renter is required to maintain adequate insurance coverage during the rental period. The Company does not provide insurance for renters. See our full Terms & Conditions (Section 18) and Waiver of Liability for details on assumption of risk, release of claims, and indemnification.
Cancellation Policy
- Free cancellation anytime before delivery — your card is not charged
- No-shows or same-day cancellations after delivery is en route — may incur a 1-day rental fee ($450)
- Weather-related cancellations — handled case-by-case; contact us as soon as possible
Governing Law
This Agreement is governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California. Both parties agree to attempt good-faith negotiation before initiating legal proceedings. Entire Agreement
This Equipment Rental Agreement, together with the Terms & Conditions (30 sections), Privacy Policy, and Waiver of Liability & Assumption of Risk, constitutes the entire agreement between the parties. Any modifications must be in writing and agreed to by both parties. Electronic signatures (including DocuSign) shall have the same legal force and effect as original handwritten signatures.
